Sony is really lucky that the PSP didn't have a dual shock feature.

Wouldn't that make it a big pager. :)
If a company makes a product, then sees another company like Sony obviously infringing on their patent, then they should be required by law report it at that time. These peeps were sitting on it and just waiting for the "ripe" oppertunity to sue Sony. On the other hand, if Sony willingly ignored these peep's patent, then this is their just desert.
I'm also wondering if the patent system is partially at fault and didn't properly identify a confilict with the Dual Shock controllers.

Personally, I dont think you should be able to sue for the system, only the controllers. If my computer has a program that has shock features, but I dont have the right equipment, should I have to pay extra because my computer has the capability to do it. I do happen to have a Sidewinder Force Feedback 2, but thats besides the point (MS already got sued for that). It should bear the cost of the patent (the patent most likely being illegal in itself), and I shouldnt have to. I do believe this is the way that it works with computers. I dont know. Is the PS2 always bundled with a shock controller, or can it be bought separately, because Sony should certainly not have to pay for a feature that some people cant even use out of the box, and if they sue the software vendors, I think someone needs to "dissapear" the company, if you know what I mean.
The patent system gets me really mad, if you havent noticed.

Yeah, the whole patent system needs to be fixed. It was supposed to promote innovation but IMHO it does the opposite - All I seem to see is companies suing people for making stuff that the company patented but doesn't even make; And usually said patent either has prior art, is ridiculously broad, ridiculously trivial or in extreme cases doesen't even apply unless certain terms are stretched beyond any reasonable meaning!
It's capitalism at it's worst.
One thing that really f'ing pissed me off is that over here, we shot down 2 (3?) attempts by those EU gits to push through a new bill on software patents, but a few weeks ago they went and made it law *anyway*!!!
Democracy my arse!!!

It's all greed and I agree that the whole patent thing needs to be revamped.
All PS2s ship with that controler and I guess the newer PS1s do also. Sony is only required to stop selling systems that ship with the dual shock.
Remember when Atari(I think it was them?) sued Sega and several other game companies in the early ninties for using their game plug design?
