It's a bit of a grey area.
The ROMs themselves are not illegal, but if you DL them but don't own the original game then this is illegal.
HOWEVER, many of those games are no longer owned by anyone - Publisher has gone under, programming house has disbanded, whatever, and they have become what's called Abandonware. Since they're no longer available and no one claims ownership anymore, they unofficially become public domain.
Websites like the underdogs could probably explain better :)
Technically Nintendo could still sue the crap out of you for playing their NES games on an emulator when you never bought the original 'tho.

with all the focus on illegal mp3 downloads nowadays, no one's gonna notice if you download ROMs of games they no longer make and you don't own, so knock yourself out. i'm surprised you couldn't find any roms cause they are everywhere.

IANAL. Anyway, actually it might even be illegal if you DO own the original game. This was part of the issues in the mp3.com lawsuit which mp3.com lost: people had copies of the CDs but downloaded the music. (Another issue was that this was for mp3.com's commercial gain.) If you own the original game, it may be legal for you to make a copy for your own use FROM your own ROM (that is, if you can have the equipment). But it may not be legal for you to make a copy from someone else's ROM or from a copy on the Internet.
And of course if you don't own the ROM, then it's illegal, plain and simple, unless the author has put it in the public domain. We should all support legislative efforts, however, to make copying of software or books legal when a publisher no longer has an interest in publishing them. Actually to my understanding....
You can't be accounted for downloading anything as being illegal, much in the same way that people who download Mp3s are not breaking the law, but the people who are sharing the downloads or offering them as downloads are breaking the Law here in the US. As for the ROMs.. You can download them... but if you use them with out legally owning the orignal ROM, than that can be considered illeagal as well.
