I've recently bought a 2nd hand Cli2 n760c, but now I foung out that the stylus keep falling out of the PDA, is it normal?
or is there some defect already with it due to use?
is there anyway to fix it?

Same experience here - used 760, loose stylus. I had a gift card to Best Buy so I bought a Belkin with a lighted tip for $10.00 US. Pretty cool, and fits snugly. You can get them online also and probably on Ebay.

I have the Belkin stylus too - it's a great fit and nice to use.

I fixed mine with an "O" ring from a disposable lighter. There used to be a web page that told you how to do it. I just took off the top of the stylus put the "O" ring on and screwed the top back on carefully. I did this about two months ago and the stylus fits just like new.

PDAPanache (http://www.pdapanache.com/products.asp?PID=SCL01) has some for the Clie N series which has the O ring. I got one for my N610C over a year ago and it's been great.
Here is the link to "o-ring" fix to loose Clie:clieuk.co.uk (http://www.clieuk.co.uk/cliestylus.htm)
I replaced my stylus with Pentopia one, which fits snugly.

I just got a secondhand 760 as well, and have the same thing. It's not like it's going to fall out or anything, but definitely not as snug as I'd like. Thanks to all above for the recommendations.

If you simply put the smallest piece of scotch tape around the top of the stylus and using an exact-o knife trim the tape around the tab so it's nice and neat. This worked great for me for the year I had a 760.
